GDPR and Affiliate Marketing

Is GDPR going to affiliate marketers? If yes, what can I do to stay complaint with its rules?

Hi Laxmi,

With regards to changes with the GDPR and how it will affect affiliate sites, our first and foremost piece of advice is to seek independent legal advice as it will have a different impact depending on where you are based, where your customers are based, what you are doing and how you are doing it. Every single site is different.

I've been wondering this myself. It seems to me that it will effect all of us affiliate marketers who have a list because someone from the European Union could find their way onto your list. And since all of us affiliate marketers are doing the same thing, why couldn't we all be doing the same thing to become GDPR compliant? Could we all use the same Privacy Policy?

It's a very confusing subject. Some people are changing their Privacy Policies to become GDPR Complaint. But it seems you have to do even more than that. Apparently if you use cookies you're suppose to give people the option of allowing cookies. I even seen someone's optin form have a box you could check which covered them in some way to do with GDPR.

Is it really necessary to seek legal advice? And how much would that cost? Couldn't we all just do the same things to become GDPR complaint?

Hi Kurt,

It is necessary to seek legal advise for this as not all businesses are the same. We cannot issue a GDPR-proofed template because it really depends on the kind of business/niche and market you are working with. The fee to this will also vary. I believe you can try to ask a legal counsel first about the fees before you seek advise.

How would you seek legal advice about this? Are there different kinds of lawyers? Would you need a specific kind of lawyer? What would you look up in the phonebook?

I am sorry but I cannot answer you properly with this one. What I suggest is you start looking for legal advise within your area, preferably with specialty in the Internet law.

GDPR is necessarily apply to affiliate marketers that do not intentionally target EU consumers with websites, content,product and currency pricing. According to me, yes GDPR is going to effect affiliate and sales.However, if you clearly targe tEU citizen in any of these ways online you, exposed to the provision.
